Welcome to ChartForma Art Gallery. These Terms & Conditions apply to purchases made through the ChartForma website and online store. By placing an order, you agree to these Terms & Conditions.
1. About ChartForma
ChartForma is an art brand operated by Byälven Förvaltning AB, Sweden.
ChartForma creates original artworks inspired by financial market data and market movements.
Each ChartForma artwork is developed through a human-led creative process involving the selection, interpretation, transformation, composition, colour treatment and artistic processing of market data.
ChartForma artworks are created for artistic purposes. They are not financial products, investment advice, trading advice, investment recommendations or forecasts.
2. Artwork and Product Information
Each ChartForma artwork is presented as an individual artistic work.
Product images are intended to represent the artwork as accurately as reasonably possible. Colours may vary slightly between screens, displays and the final printed artwork due to differences in digital displays, printing processes and materials.
Where applicable, each artwork is identified by a unique ChartForma Artwork ID and may be accompanied by a Certificate of Authenticity.
Information concerning an artwork, including the underlying market, period, time resolution and artistic style, is provided for identification and artistic context.
3. Orders
An order is placed when the customer completes the checkout process and receives an order confirmation.
ChartForma reserves the right to cancel an order in exceptional circumstances, including obvious pricing errors, technical errors, unavailable products or circumstances beyond our reasonable control.
If an order is cancelled after payment has been received, the amount paid will be refunded.
4. Prices, Taxes and Payment
Prices displayed in the ChartForma online store are shown in US Dollars (USD) unless otherwise stated.
Applicable taxes are calculated in accordance with the tax rules applicable to the transaction and the customer's location.
Shipping costs, where applicable, are shown separately during checkout.
Payment must be completed using one of the payment methods offered at checkout.
For orders shipped outside the European Union, the customer may be responsible for import duties, customs charges, local taxes or other fees imposed by the destination country.
5. Shipping and Delivery
Orders are shipped to the delivery address provided by the customer at checkout.
Estimated delivery times may vary depending on the destination, shipping method and circumstances beyond ChartForma's reasonable control.
The customer is responsible for providing a correct and complete delivery address.
If an order is delayed or lost during transportation, ChartForma will assist the customer in accordance with the applicable shipping service and consumer protection rules.
6. Right of Withdrawal, Returns and Refunds
For consumers purchasing from the European Union, statutory consumer rights apply.
Where a statutory right of withdrawal applies, the customer generally has 14 days to withdraw from a distance purchase without giving a reason. For goods, the withdrawal period normally begins on the day after the customer receives the goods.
The customer must follow the return instructions provided by ChartForma.
The cost of returning an item may be the responsibility of the customer where permitted by applicable law and where this has been properly communicated before purchase.
Certain products may be excluded from the right of withdrawal where a legal exception applies, including goods that are genuinely made to the customer's specifications or clearly personalised.
A standard ChartForma artwork offered in a fixed format or standard size is not automatically considered personalised merely because it is produced after an order is placed.
If an artwork arrives damaged, the customer should contact ChartForma as soon as reasonably possible and provide photographs of the artwork and packaging.
Nothing in these Terms & Conditions limits any mandatory consumer rights applicable to the customer.
7. Digital Products
Where ChartForma offers digital artworks or other digital content for purchase, additional information about the product, delivery method and permitted use will be provided before purchase.
Where applicable law provides a right of withdrawal for digital content, that right may be affected if the customer expressly requests that delivery begins before the withdrawal period has expired and acknowledges the applicable loss of the right of withdrawal.
Digital products are supplied for the customer's personal use unless otherwise expressly stated.
8. Copyright and Intellectual Property
All rights in ChartForma's original creative material are reserved to the extent provided by applicable law.
ChartForma artworks are developed through a human-led creative process involving artistic selection, interpretation, composition, transformation, editing, colour treatment, structure, density, form and other creative decisions.
Financial market data itself is not claimed as exclusive intellectual property of ChartForma. The artistic expression resulting from ChartForma's creative selection, arrangement, transformation and interpretation of such data is treated separately from the underlying data.
Digital tools, including AI-assisted tools, may form part of the creative process. The final artwork is individually selected, directed, edited and refined as part of the human-led artistic process.
Purchase of a physical artwork does not transfer copyright or reproduction rights to the purchaser.
Unless expressly authorised in writing, the purchaser may not reproduce, scan, digitally distribute, commercially reproduce, modify for redistribution, or commercially exploit any ChartForma artwork.
The same applies to ChartForma's website content, photographs, texts, logos, designs and other original material.
9. Certificate of Authenticity
Where a Certificate of Authenticity is supplied, it forms part of the documentation associated with the relevant artwork.
The Certificate may include information such as:
- Artwork title
- ChartForma Artwork ID
- Market or instrument
- Period
- Time resolution
- Artistic style
- Edition information, where applicable
The Certificate does not transfer copyright or reproduction rights.
10. Financial Disclaimer
ChartForma artworks may incorporate historical or other financial market data for artistic purposes.
Nothing on this website or contained within a ChartForma artwork constitutes financial advice, investment advice, trading advice, an investment recommendation or a forecast of future market performance.
ChartForma does not provide investment services through the sale of its artworks.
11. Website Content
ChartForma makes reasonable efforts to ensure that information on the website is accurate and up to date.
However, occasional errors, omissions or technical problems may occur.
ChartForma reserves the right to update product information, prices, descriptions and website content.
12. Limitation of Liability
To the extent permitted by applicable law, ChartForma shall not be liable for indirect or consequential losses arising from the use of the website or the purchase of ChartForma products.
Nothing in these Terms & Conditions excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by applicable law.
13. Changes to These Terms
ChartForma may update these Terms & Conditions from time to time.
The version applicable to an order is the version in effect when the order was placed, unless applicable law requires otherwise.
14. Governing Law and Consumer Rights
These Terms & Conditions are governed by the laws applicable to the business operated by Byälven Förvaltning AB in Sweden.
Where the customer is a consumer, nothing in these Terms & Conditions limits any mandatory consumer protection rights that apply in the customer's country of residence.
